1. Pillage is a common violent crime, which criminal judicatory and criminal theoretics have been paying much attention to and the study on it has been very active. But these academic studies refer less to the pillage aggravations. Since the criminal law constituted in 1997 crystallized the aggravations, many studies only pay more attention to the comprehension and application of the eight aggravations while paying less to other questions such as criminal conformation, approximate pillage applying aggravations, etc, resulting in lagging study and many divergences. The main problem is that in China the foundation academic studies on aggravations are not enough, which affects the studies on pillage aggravations and the application in criminal judicatory practices.
抢劫罪是一项常见多发的暴力犯罪，刑事司法和刑事理论界一直对其给予了较多关注，因此对抢劫罪的个罪理论研究比较活跃，但是这些理论研究较少涉及抢劫罪加重犯问题。97刑法对抢劫罪的加重情节具体化后，许多研究也只着眼于对这八种加重情节的理解适用，而对抢劫加重犯的其他问题如犯罪形态、准抢劫罪适用加重情节等仍较少关注，研究也就显得比较滞后，观点分歧也较大，主要问题是我国刑法界对加重犯的基础理论研究还不够，继而影响到抢劫罪加重犯问题的研究，影响到刑事司法实践中对抢劫罪加重情节的适用。
